NOTICE OF OPEN MEETING & VOTE TO CLOSE PART OF THE MEETING
Notice is hereby given that the City of Memphis Board of Aldermen will conduct an open meeting at 6:30 p.m. on Thursday, March 3, 2022 at the Memphis City Hall, 125 W. Jefferson, Memphis, Missouri.
The tentative agenda of this meeting includes:
AN ORDINANCE IMPOSING A SALES TAX OF ONE-HALF OF ONE PERCENT FOR THE OPERATION OF THE CITY OF MEMPHIS, MISSOURI FIRE DEPARTMENT, ON ALL RETAIL SALES MADE WITHIN THE CORPORATE BOUNDARIES OF THE CITY OF MEMPHIS, MISSOURI, PURSUANT TO SECTION 321.242 RSMo., WHICH ARE SUBJECT TO TAXATION UNDER THE PROVISIONS OF SECTION 144.010 TO 144.525, RSMo., AFTER SUBMISSION TO AND CONTINGENT UPON APPROVAL BY A MAJORITY OF THE QUALIFIED VOTERS OF THE CITY OF MEMPHIS, MISSOURI, AT AN ELECTION TO BE HELD ON TUESDAY, AUGUST 2, 2022

AN ORDINANCE IMPOSING A SALES TAX OF ONE-HALF OF ONE PERCENT FOR THE OPERATION OF THE CITY OF MEMPHIS, MISSOURI FIRE DEPARTMENT, ON ALL RETAIL SALES MADE WITHIN THE CORPORATE BOUNDARIES OF THE CITY OF MEMPHIS, MISSOURI, PURSUANT TO SECTION 321.242 RSMo., WHICH ARE SUBJECT TO TAXATION UNDER THE PROVISIONS OF SECTION 144.010 TO 144.525, RSMo., AFTER SUBMISSION TO AND CONTINGENT UPON APPROVAL BY A MAJORITY OF THE QUALIFIED VOTERS OF THE CITY OF MEMPHIS, MISSOURI, AT AN ELECTION TO BE HELD ON TUESDAY, AUGUST 2, 2022
WHEREAS, Section 321.242, RSMo., provides that a municipality having a municipal fire department may impose a sales tax in amount up to one-half of one percent on all retail sales within the corporate boundaries of the city that are subject to taxation pursuant to Section 144.010 to 144.525, RSMo.; and
WHEREAS, under the provisions of Section 321.242, RSMo., no ordinance enacted pursuant to the authority granted by the provisions of said Section shall be effective until it has been submitted to the qualified voters of the City and approved by a majority of the qualified voters voting thereon;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF MEMPHIS, MISSOURI, AS FOLLOWS:
SECTION 1. Pursuant to the authority granted by and subject to the provisions of Section 321.242 RSMo., a sales tax in the amount of one-half of one percent shall be imposed on all retail sales made within the corporate boundaries of the City of Memphis, Missouri which are subject to taxation under Sections 144.010 to 144.525, RSMo. The sales tax shall become effective and shall be collected pursuant to the provisions of Section 321.242, RSMo., and Sections 32.085 and 32.087, RSMo. The sales tax authorized by Section 321.242, RSMo., shall be in addition to other sales taxes allowed by law, as provided for by Section 321.242, RSMo.
SECTION 2. This Ordinance shall be submitted to the qualified voters of the City of Memphis, Missouri for their approval, as required by the provisions of Section 321.242 RSMo., at the election to be held in the City of Memphis, Missouri, and an election is hereby ordered to be held on Tuesday, August 2, 2022. The ballot submission shall contain the following language:
Shall the City of Memphis, Missouri, impose a sales tax of one-half of one percent for purposes of providing revenues for the operation of the municipal fire department?

SECTION 3. If a majority of the qualified voters voting at said election shall vote in favor of the approval of this Ordinance, then the same shall be in effect. If a majority of the votes cast by the qualified voters voting are opposed to the proposal, then the governing body of the City of Memphis, Missouri, shall not impose the sales tax authorized by Section 342.242, RSMo., unless and until the governing body of the City of Memphis, Missouri, resubmits a proposal to authorize the City of Memphis, Missouri, to impose the sales tax authorized by Section 342.242, RSMo, and such proposal is approved by a majority of the qualified voters voting thereon.
SECTION 4. The City Clerk is hereby authorized and directed to notify the County Clerk of Scotland County, Missouri, of the passage of this Ordinance no later than 5:00 P.M. on Tuesday, May 24, 2022, and to include in said notification all of the terms and provisions required by Chapter 115, RSMo., as amended.
SECTION 5. Within ten (10) days after the approval of this Ordinance by the qualified voters of the City of Memphis, Missouri, the City Clerk shall forward to the Director of Revenue of the State of Missouri by the United States registered mail or certified mail, a certified copy of this Ordinance together with certification of the election returns and accompanied by a map of the City clearly showing the boundaries thereof.
SECTION 6. All revenue received by the City of Memphis, Missouri, from the sales tax authorized pursuant to this Ordinance, if approved by the qualified voters of the City of Memphis, Missouri, shall be deposited in a special trust fund and shall be used solely for the operation of the municipal fire department.
SECTION 7. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed insofar as they do conflict.
SECTION 8. This Ordinance shall be in full force and effect from and after its passage and approval.
